Shelters will be open all day long. Additionally, a Code Red air quality forecast has been issued for today. NWS currently forecasts that the Heat Index will reach 95? each day until the middle of next week. The District of Columbia Government will implement the Heat Emergency ?Cooling Centers and Street Showers? Program for designated periods of time today, in identified District and public facilities, as well as public housing senior facilities, senior centers and homeless shelters throughout the city. Areas have been designated for street showers based upon their history of unauthorized use of fire hydrants during extremely hot weather, which in turn lowers the water pressure in these areas. The low water pressure poses health and safety problems, especially as it relates to fire suppression. Public swimming pools will extend hours of normal operation. The Department of Human Services will open homeless shelters any day the temperature or the heat index exceeds ninety five degrees. The Department of Human Services? hyperthermia hotline ? 1-800-535-7252 - will be activated. A number of cultural and community programs will get needed support for operation and construction. I introduced $1,000,000 for capital improvements for the Lincoln Theater. Community initiatives are a big part of the theater's mission. $200,000 in grants will go to support its performance-based activities--including local arts groups and school cultural growth programs. In Columbia Heights, I authored $450,000 for historic preservation of the Tivoli Theatre. This will include funds to restore the Gala Hispanic Theater's dome and the Battisi murals. $300,000 in grants will support the Dance Institute of Washington's community programs. The institute runs three after school dance programs that are free for young children. Classes include ballet, contemporary movement and one, for teens, focuses on choreography and production. In Adams Morgan, $100,000 will go to restore the Avalon Apartment's fa?ade and exterior. The building was the subject of a five alarm fire in October, 2007. I authored $200,000 for the ProUrbanYouth program to expand from six to 10 weeks. Over 500 young people across the city started jobs with the program this summer. The pedestrian and bicycle plans are getting needed enhancements. Better marking and more time will be given at crosswalks at specified intersections. Additional sidewalks will also be laid throughout the city. There was a 50% rise in walker/biker deaths related to car crashes last year. This issue has been especially troublesome in our densely populated Ward. Accidents at the intersection of 14th and U Street have been among the highest in the city. Improving the biker and pedestrian plans will bring much needed progress. I also introduced several city-wide bicycle initiatives. The plans include: - $60,000 to improve bicycle and parking access at District government buildings - $72,000 for staff support for the Bicycle Advisory Council - $18,000 for Public Service Announcements promoting safer driving Additionally, I provided $150,000 to support a partnership between Metro and City Year. The Public Safety & Ambassador Program will train City Year members to help on various projects in the Metrorail system. City Year is one of the most active community service organizations in DC. The owner, Mr. David Cormier was charged with both criminal and civil violations, and taken to court on criminal charges. Below I share with you information sent to me on the criminal legal action taken by the Office of Attorney General of the District. There is good news. Especially positive is to hear that Mr. Cormier must correct building violations at Hiatt Street and four other apartment buildings he owns. One of these buildings is 2920 Ontario Rd NW in Adams Morgan...like Hiatt, my staff and I have been very involved there as well. I commend the Interim Attorney General Nickles and his staff for this good work. Tenants have a right to expect clean, safe housing. This action sends a strong message to slumlords that renters cannot be abused and that buildings cannot be neglected. Bests, Councilmember Jim Graham ---------------------------- Received from the Office of Attorney General On May 14, 2008 David Cormier pled guilty to 22 counts of failure to abate housing code violations in the apartment building that he owns located at 3228 Hiatt Place N.W. Washington, D.C. As part of the plea agreement made pursuant to Rule 11(e) (1) (C) of the Superior Court Rules of Criminal Procedure, Mr. Cormier was sentenced by Judge Russell Canan to a total period of 1320 days of incarceration. Execution of sentence was suspended and Mr. Cormier was placed on probation for three years. As a condition of probation Mr. Cormier agreed to donate $50,000 (fifty-thousand) to Bread for the City. Mr. Cormier also agreed as a condition of probation that he would fulfill the agreement that he recently entered into with the tenants of the building to compensate them for the substandard housing conditions that they have endured and to provide them with funds for relocation because the building must be vacated in order to allow for renovation of the property. The tenants were represented by the law firm of Jones Day for purposes of reaching an agreement with Mr. Cormier. OAG was not involved with the tenant agreement with Mr. Cormier. Judge Canan also ordered Mr. Cormier to perform 50 hours of community service. As a final condition of probation Mr. Cormier must not to violate the criminal laws of the District of Columbia, including but not limited to, violations of the Housing and Fire Codes of the District of Columbia. Mr. Cormier owns four other apartment buildings in Northwest Washington and must abate all housing code violations in those buildings. Judge Canan has also ordered OAG to report to the court every six months during the three year probationary period as to Mr. Cormier's compliance with the conditions of probation. Earlier this week, I reported to you the successful prosecution of David Cormier, the owner of 3228 Hiatt Pl. by the DC Attorney General. The prosecution resulted in a criminal conviction on 22 counts of housing violations. To avoid serving jail time, Mr. Cormier negotiated a plea bargain agreement with the Attorney General's Office on the criminal charges. A separate settlement directly with the tenants was reached in a civil case. The family moved from 3228 Hiatt Place due to terrible conditions in the building.
